Krumwiede Roofing & Exteriors Limited Lifetime Workmanship Warranty Limited Warranty for Manufacturing Defects.
During the period in which the material warranty is active, if all or any part of a product is found to have a manufacturing defect, Krumwiede Roofing & Exteriors will arrange with the manufacturer to have the defective portion of the product repaired/replaced. Krumwiede will aid the Owner in starting the claim and follow through the process until the claim is closed.
Limited Warranty for Misapplication.
During the period in which the workmanship warranty is active, if all or any part of a product is found to have application errors, Krumwiede Roofing & Exteriors will arrange to have the defective portion of the product repaired or, at its sole option, provide the Owner with a replacement product and reimburse the Owner for the full reasonable cost of labor. The cost of labor to remove the product and dispose of the existing product is not included in this warranty.
How to Obtain Warranty Service.
To submit a claim, the Owner must send a notice of claim in writing together with proof that this warranty was registered to the Owner with Krumwiede Roofing & Exteriors at 1330 W. Irving Park Rd, Bensenville, and IL 60106. Claims must be submitted to Krumwiede Roofing & Exteriors within thirty (30) days after discovery of the claimed defect. Krumwiede Roofing & Exteriors may require the Owner to submit, at the Owner’s expense, sample products for testing and photographs. Krumwiede Roofing & Exteriors will then schedule an appointment to inspect the premises and the warranty claim within a reasonable period of time after having received the claim. If after inspection, Krumwiede Roofing & Exteriors determines that a valid claim exists under one or more of the warranties, Krumwiede Roofing & Exteriors will help start the manufacturer claim, repair, re-install, or replace the failing product as originally installed. If product is no longer available, Krumwiede Roofing & Exteriors shall have the right to substitute a product designated by Krumwiede Roofing & Exteriors to be equal quality. Replacement of a product or component does not renew the warranty period. Minor color variations may exist between replacement product and the originally installed product and are not indicative of a defective product. If, at Krumwiede Roofing & Exterior’s option, a purchase price refund is conveyed to the Owner, then all warranties are terminated, and repair, replacement, or removal of Krumwiede roofing & Exteriors products shall become the sole responsibility of the Owner. If the Krumwiede Roofing & Exterior inspection determines that the claim is not covered by the warranty, the Owner agrees to pay Krumwiede Roofing & Exteriors a $250 fee to offset Krumwiede Roofing & Exterior’s cost of inspecting the Owner’s claim. This warranty will be cancelled if the Owner fails to pay fee within 30 days of receipt of an invoice for it. No warranties are valid unless and until the Owner has made full payment under the original Krumwiede Roofing & Exterior sales agreement and addenda thereto. Non-warranty calls for repair or adjustment may result in a service charge. This warranty will not take effect unless all eligibility requirements have been satisfied and Krumwiede Roofing & Exteriors has been paid in full.
What is not Covered.
There warranties are granted by Krumwiede Roofing & Exteriors to the Owner only and only products purchased from and installed by Krumwiede Roofing & Exteriors are covered by these warranties. All warranties terminate immediately upon the transfer of home ownership, unless the terms of transfer are met (see “How to Transfer These Warranties” below). All warranties assume normal and reasonable use of Krumwiede Roofing & Exteriors products. Minor color or textural variations from lot-to-lot of product are not product or installation defects. These warranties do not cover 1) any damage to the Owner’s product from anything other than an inherent manufacturing defect in the product, their misapplication or their failure to seal, or the misapplication of flashing, such as inadequate attic ventilation or application of shingle/membrane directly to insulation or to an insulated deck unless prior written authorizations obtained by Krumwiede Roofing & Exteriors (ventilation must meet at least FHA Minimum Property Standards); 2) deterioration of caulking compounds, fire, flood, lightning, high winds, windblown objects, earthquake, hurricanes, ice dams, icicles and/or ice storms, atmospheric conditions or weather of catastrophic nature as defined by the United States National Weather Service, other acts of God, impact of foreign objects or traffic on the product, improper storage or handling of any products, and any weather event that a homeowners insurance policy will cover; 3) any condition (e.g. base flashing height or lack of counter-flashing) that is not in accordance with NRCA standards; 4) conditions that prevent positive drainage or result from ponding water; 5)damage caused by settlement , condensation, or chemical attach including exposure to oil or grease; 6) shading or variations in the color of the Owner’s shingles/siding or contamination caused by fungus, algae, or other contaminants; 7) changes to the color of the wood or exterior aluminum on skylights caused by ultraviolet rays; 8) damage caused by products not supplied by Krumwiede Roofing & Exteriors; 9) improperly designed or installed gutter or downspout system (if not installed by Krumwiede Roofing & Exteriors); 10) damage to the interior or exterior of any building, including, but not limited to, mold growth; 11) damage to or caused by rooftop air conditioning units (and their flashing) pipe works, brace works, rooftop satellite dishes or other radio/TV devices, counter-flashings, or flashings other than those specifically included above. The Owner understands and acknowledges that fogging or condensation on skylights resulting from interior building humidity or indoor/outdoor temperature differences is a result of environment conditions, not a manufacturing defect.
What Voids these Warranties.
Installation, removal, painting, repair, adjustment, tampering, or re-installation of any Krumwiede Roofing & Exteriors products or components by other than Krumwiede Roofing & Exteriors voids any and all warranties within this document, and Krumwiede Roofing & Exteriors expressly disclaims any liability for any cost, defects, or damages with respect to such actions.
Remedies and Rights.
These warranties of Krumwiede Roofing & Exterior’s products and services are the only expressed warranties provided by Krumwiede Roofing & Exteriors. No employee, representative, agent, nor any other person, has authority to assume or incur on behalf of Krumwiede Roofing & Exteriors any obligation, liability, or responsibility in place of or in addition to these warranties. IN NO EVENT SHALL THE DURATION OF ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE BE LONGER THAN THE DURATION OF WARRANTY BY THE ORIGINAL OWNER (OR SECONDARY HOMEOWNER AS PER THE BELOW STATED CONDITION FOR TRANSFER) OF THE HOME ON WHICH KRUMWIEDE ROOFING & EXTERIORS PRODUCT IS INSTALLED. EXCEPT FOR THE WARRANTY PROVIDED HEREIN, KRUMWIEDE ROOFING & EXTERIORS MAKE NO WARRANTY OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF NONINFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. KRUMWIEDE ROOFING & EXTERIOR’S LIABILITY TO THE OWNER (OR ANY SECONDARY HOMEOWNER) UNDER THIS DOCUMENT IS LIMITED TO THE AMOUNTS RECEIVED BY KRUMWIEDE ROOFING & EXTERIORS BE OBLIGATED OR LIABLE FOR INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES OF ANY KIND FOR THE BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OF KRUMWIEDE ROOFING & EXTERIOR PRODUCT OR SERVICES. SOME STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF INCIDENTIAL OR CONSEQUENTIAL DAMAGES, AND THEREFORE SOME OR ALL OF THE IMMEDIATELY PRECEDING SENTENCE MAY NOT APPLY. THESE WARRANTIES PROVIDE SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS, WHICH VARY FROM STATE TO STATE.
How to Transfer These Warranties.
Subject to the other terms and contained in the document, these warranties are transferable once by the Owner to a Second Owner and the Second Owner shall be entitled to all benefits contained in this warranty. In order for the transfer of this warranty to the Second Owner to be valid, the Second Owner must notify Krumwiede Roofing & Exteriors in writing within thirty (30) days after the property transfer has occurred and pay on-time fee of $1,250or $1 per square foot, whichever is greater. This fee must be received within the 30 days of property transfer a well. Failure to meet these requirements will void this warranty.
